Description of risks to contract performance

The Contracting Authority recognises that, due to the nature of behavioural assessment services and the need to respond to evolving clinical, operational, and safety risks, it may be necessary to modify the contract during its term.

The principal risks which may give rise to modification include:

material variation in service demand, including changes in the volume, complexity, or urgency of behavioural assessments;

updates to clinical guidance, regulatory frameworks, or professional standards;

emerging risks relating to practitioner behaviour, patient safety, staff safety, or public confidence requiring changes to delivery models or escalation processes;

the need to adjust performance requirements, including report turnaround times, quality assurance mechanisms, or escalation protocols;

organisational changes impacting how services are commissioned or managed within NHS Resolution or the NHS.

Any contract modification will:

be strictly limited to circumstances permitted under the Procurement Act 2023;

not alter the overall nature of the contract;

be proportionate to the risk being addressed; and

be clearly documented and justified to ensure transparency and auditability.
